BINDING EFFECT.
This is a binding agreement. By using the Internet site located at https://www.brittanyveney.com or https://www.brealcreativestudio.com (the “Site” or “Service”) or any services provided in connection with the Site, you agree to abide by these Terms of Use, as they may be amended by Veney Virtual Business Solutions, LLC (DBA B. Real Creative Studio (“BRCS”)) from time to time.
PRIVACY POLICY.
B. Real Creative Studio respects your privacy and permits you to control the treatment of your personal information. A complete statement of B. Real Creative Studio’s current privacy policy can be found by clicking the “privacy” link at the bottom of the page. B. Real Creative Studio’s privacy policy is expressly incorporated into this Agreement by this reference.
GOVERNING LAW.
These Terms shall be construed in accordance with and governed by the laws of the United States and the State of Maryland, without reference to their rules regarding conflicts of law. You hereby irrevocably consent to the exclusive jurisdiction of the state or federal courts in Oakland, Maryland in all disputes arising out of or related to the use of the site.
AGE.
The site is intended only for users aged 18 or older. Individuals under the age of 18 are strictly prohibited from using the site and the accounts for any such person shall be terminated upon discovery.
This section applies specifically to all digital products and subscription-based design services (“Monthly Design & Marketing Support”) offered by B. Real Creative Studio via the website and any affiliated platforms. By accessing or purchasing these services, you agree to the following terms in addition to the full Terms of Service.
Clients are solely responsible for any data, materials, or content transmitted through or associated with their use of B. Real Creative Studio’s website, platforms, or services. This includes account information, submitted content, project briefs, feedback, and uploaded files (“Client Materials”). B. Real Creative Studio is not liable for any loss, corruption, or unauthorized access to Client Materials and the Client waives any claims or actions against B. Real Creative Studio in connection with such events.
The primary subscriber is considered the account owner (“Account Owner”) and may designate additional users (“Client-Added Users”) and administrators (“Administrators”) to access and manage the subscription account. Administrators and Client-Added Users may be granted permission to submit design requests, provide feedback, and download deliverables.
By adding users, the Client represents and warrants that all necessary permissions and consents have been obtained. It is the Client’s responsibility to ensure that all Client-Added Users are properly authorized, assigned appropriate permissions, and removed from the account when no longer needed.
If you are a Client-Added User, you acknowledge that any materials you upload or requests you create may be visible to and managed by the Account Owner and Administrators, including reassignment or deletion. B. Real Creative Studio is not responsible for unauthorized actions taken by Administrators or other users under the Client’s account.
Design Requests and Project Flow
Clients may submit an unlimited number of design requests (“Requests”), provided the account is active and in good standing. Each monthly retainer allows a specific number of Requests to be actively worked on at any given time (“In Progress”).
For example, if your plan allows 1 In Progress design, we will actively work on one request from your queue at a time. Once that request moves into review or is marked complete, the next request in your queue begins. Higher-tier plans allow for multiple concurrent designs.
“In Progress” Requests are considered “Active.” Once a draft is delivered, the request will be marked “Reviewing.” If revisions are submitted, it will move to “Revising.” A request is considered complete once:
The Client selects “Mark as Completed”
The Client does not respond to a draft or revision request within seven (7) calendar days
Further changes after completion will be handled at the discretion of B. Real Creative Studio and may require a new request or additional fee.
While requests and revisions are unlimited, actual turnaround times depend on:
The plan tier selected
The number and complexity of requests
The quality and clarity of the design brief
The number of active requests permitted under your plan
The responsiveness of the Client in providing feedback
We make every effort to deliver designs in a timely and efficient manner, but no guarantees are made regarding specific delivery timelines.
Clients are responsible for ensuring that all design briefs and uploaded materials are accurate, complete, and aligned with the intended use of the final design. Clear instructions result in better outcomes.
B. Real Creative Studio is not liable for delays or errors caused by vague, incomplete, or inaccurate requests. It is the Client’s responsibility to carefully review all deliverables, especially for print or public-facing use (e.g., banners, packaging, business cards, PDFs, signage, QR codes, etc.).
We strongly recommend test printing your design before submitting it to any printer. If you find any errors or inaccuracies, it is your responsibility to request revisions before marking the Request as complete or proceeding with distribution.
Clients may assign “Collaborators” to specific Requests to assist in providing feedback, uploading files, or managing project details. Collaborators are granted full access to the Request and may modify, comment on, or download deliverables.
It is the Client’s responsibility to ensure that Collaborators are authorized, appropriately assigned, and promptly removed when no longer needed. B. Real Creative Studio is not responsible for unauthorized actions taken by Collaborators or other users with shared access.
Extremely complex or fine art illustrations
Complex photo manipulation
Digital painting or game assets
3D or CAD projects
Programming, HTML/CSS, UI/UX, or web development
Content writing or copy creation
Projects requiring unsupported file formats
Designs involving trademarked names, logos, or quotes
All digital products sold by B. Real Creative Studio, including those offered through the Designs in a Dash marketplace, are subject to a Standard Commercial Use License unless otherwise specified. This license allows you to edit and use the templates for your own brand or business marketing purposes. Reselling, redistributing, or sharing the original or edited designs is strictly prohibited.
All content, branding, templates, and digital designs offered through this website remain the intellectual property of B. Real Creative Studio. Purchasing a product does not grant ownership or rights to the original design files beyond the agreed license terms.
If you intend to use our templates for client work or resale purposes, you must obtain a separate Extended Use License. Contact info@brealcreativestudio.com for details.
Due to the nature of digital downloads, all sales are final. We do not offer refunds, returns, or exchanges on digital products. Please read product descriptions carefully before purchasing.
The Website Care Plan is a monthly maintenance service designed to support websites that have been designed and developed by B. Real Creative Studio only. This plan includes the following services:
Monthly CMS and plugin updates
Monthly secure website backups
SEO check-ups
Basic security scans
Monthly website analytics report
Up to two (2) minor fixes per month (limited to tasks taking 30 minutes or less each, such as image or text swaps, broken link repair, or layout adjustments)
This plan does not include:
Major content updates or redesigns
New feature integrations or development
Custom coding or server-related issues
Ongoing design work (unless covered under a Design Subscription)
The Website Care Plan is not transferable and is only valid for the original website created by B. Real Creative Studio. If the Client or a third party alters the website’s core files, structure, or plugins, B. Real Creative Studio may, at its discretion, terminate or suspend the Care Plan due to compatibility or security concerns.
Clients are responsible for requesting their two (2) monthly minor fixes via the designated support form or communication channel. Unused minor fixes do not roll over to the next month. Additional maintenance or updates beyond the included services may be quoted separately.
The Website Care Plan is billed monthly or annually, as selected by the Client. Canceling the Website Care Plan will terminate monthly reporting, monitoring, and all included support services at the end of the current billing cycle.
File Ownership & Licensing
Clients receive non-exclusive, non-transferable usage rights for all files delivered. You are responsible for reviewing the designs for proper usage rights, especially when it comes to stock assets, fonts, or content provided by you.
Third-Party Assets: Any templates or designs utilizing third-party stock imagery, illustrations, or fonts may require separate licensing. B. Real Creative Studio will notify clients if additional licenses are needed to legally use the asset.
Marketplace Digital Products (The Shop)
Digital templates purchased via the Designs in a Dash shop (“The Shop”) are for personal or single-client business use only unless explicitly stated otherwise. Templates may not be resold, redistributed, or repurposed as your own design or service offering.
Canva Use: All templates are created in Canva. Instructions for use are provided with each product.
Support: Questions regarding templates must be submitted via the Support Ticket form.
No Refunds: Due to the digital nature of our products, all sales are final. We do not offer refunds or exchanges.
Request Conduct and Expectations
All design briefs must be submitted with clear, specific, and complete instructions. Incomplete briefs will be returned.
You are expected to review and respond to proofs within 5 business days. Requests inactive for 7+ days may be marked complete.
Repeated failure to provide timely feedback or approval will affect queue timelines.
Client Accounts and Collaborators
Only authorized users may submit or manage design requests under your account. If you add collaborators, you assume full responsibility for their access and the accuracy of their input. B. Real Creative Studio is not liable for unauthorized or erroneous submissions made by your collaborators.
USER CONTENT.
You grant B. Real Creative Studio a license to use the materials you post to the Site or Service. By posting, downloading, displaying, performing, transmitting, or otherwise distributing information or other content (“User Content”) to the Site or Service, you are granting B. Real Creative Studio, its affiliates, officers, directors, employees, consultants, agents, and representatives a license to use User Content in connection with the operation of the Internet business of B. Real Creative Studio, its affiliates, officers, directors, employees, consultants, agents, and representatives, including without limitation, a right to copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate, and reformat User Content. You will not be compensated for any User Content. You agree that B. Real Creative Studio may publish or otherwise disclose your name in connection with your User Content. By posting User Content on the Site or Service, you warrant and represent that you own the rights to the User Content or are otherwise authorized to post, distribute, display, perform, transmit, or otherwise distribute User Content.
COMPLIANCE WITH INTELLECTUAL PROPERTY LAWS.
When accessing the Site or using the Service, you agree to obey the law and to respect the intellectual property rights of others. Your use of the Service and the Site is at all times governed by and subject to laws regarding copyright ownership and use of intellectual property. The burden of proving that any Content does not violate any laws or third party rights rests solely with you.
INAPPROPRIATE CONTENT.
You shall not make the following types of Content available. You agree not to upload, download, display, perform, transmit, or otherwise distribute any Content that (a) is libelous, defamatory, obscene, pornographic, abusive, or threatening; (b) advocates or encourages conduct that could constitute a criminal offense, give rise to civil liability, or otherwise violate any applicable local, state, national, or foreign law or regulation; or (c) advertises or otherwise solicits funds or is a solicitation for goods or services. B. Real Creative Studio reserves the right to terminate your receipt, transmission, or other distribution of any such material using the Service, and, if applicable, to delete any such material from its servers. B. Real Creative Studio intends to cooperate fully with any law enforcement officials or agencies in the investigation of any violation of these Terms of Use or of any applicable laws.
ALLEGED VIOLATIONS.
B. Real Creative Studio reserves the right to terminate your use of the Service and/or the Site. To ensure that B. Real Creative Studio provides a high quality experience for you and for other users of the Site and the Service, you agree that B. Real Creative Studio or its representatives may access your account and records on a case-by-case basis to investigate complaints or allegations of abuse, infringement of third party rights, or other unauthorized uses of the Site or the Service. B. Real Creative Studio does not intend to disclose the existence or occurrence of such an investigation unless required by law, but B. Real Creative Studio reserves the right to terminate your account or your access to the Site immediately, with or without notice to you, and without liability to you, if B. Real Creative Studio believes that you have violated any of the Terms of Use, furnished B. Real Creative Studio with false or misleading information, or interfered with use of the Site or the Service by others.
NO WARRANTIES.
B. REAL CREATIVE STUDIO HEREBY DISCLAIMS ALL WARRANTIES. B. REAL CREATIVE STUDIO IS MAKING THE SITE AVAILABLE “AS IS” WITHOUT WARRANTY OF ANY KIND. YOU ASSUME THE RISK OF ANY AND ALL DAMAGE OR LOSS FROM USE OF, OR INABILITY TO USE, THE SITE OR THE SERVICE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, B. Real Creative Studio works with a number of partners and affiliates whose Internet sites may be linked with the Site. Because neither B. Real Creative Studio nor the Site has control over the content and performance of these partner and affiliate sites, B. Real Creative Studio makes no guarantees about the accuracy, currency, content, or quality of the information provided by such sites, and B. Real Creative Studio assumes no responsibility for unintended, objectionable, inaccurate, misleading, or unlawful content that may reside on those sites. Similarly, from time to time in connection with your use of the Site, you may have access to content items (including, but not limited to, websites) that are owned by third parties. Recurring Payments. If you have signed up for a payment plan, you hereby authorize our continued access to your financial information stored by our third party financial processing company referenced in this Agreement until your payment plan is complete, as set forth in your acceptance of the purchase terms upon checkout.
Subscriptions can be canceled at any time, but refunds are not issued for unused time or credits. If payment fails or is late, your design queue will pause until the balance is settled. Abuse of the system or repeated violations of the request policy may result in account termination.
Late Payments. If payments are not made on time, you agree to pay interest on all past-due sums at a rate of 1.5% per month or the highest rate allowed by law, whichever is greater.
Chargebacks. You agree to make every attempt to request a refund prior to attempting a chargeback with your financial institution. In the event of a chargeback attempt, you expressly agree to forfeit any and all of our bonuses, affiliate bonuses or other materials afforded to you in exchange for your original purchase of our Course. We reserve the right to present proof of your access and these Terms to the financial institution investigating the dispute.
MISCELLANEOUS.
The Company reserves the right, in its sole discretion, to terminate a customers access to its Facebook groups.
AMENDMENTS.
The Company reserves the right, in its sole discretion, to change the Terms under which the Website is offered. The most current version of the Terms will supersede all previous versions. The Company encourages you to periodically review the Terms to stay informed of our updates.
Should a court of competent jurisdiction rule this Amendment provision invalid, then this Amendment clause shall be terminated as part of this agreement with the agreement between us reverting to the previous set of terms applicable to the website. All amendments to the Terms shall be forward looking.
